Terms and conditions of sale

This translation is provided for information. In case of discrepancy, the French version prevails.

Article 1 – Purpose

These Terms and Conditions of Sale (T&Cs) govern the contractual relationship between ColoBloom (hereinafter ‘the Seller’), operator of the colobloom.fr website, and any buyer (hereinafter ‘the Customer’) wishing to make a purchase on this website.

Article 2 – Prices

Product prices are shown in euros, all taxes included. The Seller reserves the right to change its prices at any time, it being understood that the price applicable to an order is the one in force when the order is confirmed.

Article 3 – Orders

Any order placed on the website implies acceptance of these T&Cs. The Customer certifies that they have the legal capacity to enter into a contract. The order is final once payment is confirmed.

Article 4 – Payment

Payment is made online by bank card (Visa, Mastercard) via a secure payment solution. The amount is charged when the order is confirmed.

Article 5 – Delivery

We deliver to mainland France, the French overseas territories and the European Union. For delivery outside the EU, please contact us.

Orders are processed and shipped within 1 to 3 business days after payment is confirmed. During busy periods (sales, holidays), this may take slightly longer.

Mainland France:

  • Colissimo (tracked): 2 to 3 business days after shipping
  • Express delivery: 1 to 2 business days (if available)
  • Pickup point: 3 to 5 business days

European Union:

  • Standard delivery: 5 to 10 business days

Shipping costs are shown when you place your order. Delivery to a pickup point is free on orders from €69. A shipping confirmation email with a tracking number is sent as soon as the parcel leaves.

Article 6 – Right of withdrawal

In accordance with Article L.221-18 of the French Consumer Code, the Customer has 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to give reasons or pay penalties. Return costs are borne by the Customer, except for defective products or order errors.

To exercise this right, the Customer must notify their decision to contact@colobloom.fr, stating their order number, or by using the model withdrawal form provided in Article 11 of these T&Cs (no reason needs to be given). To be accepted, the returned product must be unused, in its blister and intact original packaging, together with the order form or proof of purchase.

Article 7 – Refunds

Once the return has been received and checked, the refund is made within 14 days at most, using the same payment method as for the purchase.

If the Customer has received a defective product or one that doesn't match their order, they must contact the Seller immediately at contact@colobloom.fr with a photo of the product. The Seller will cover the return costs and arrange an exchange or a full refund.

Article 8 – Legal guarantees

Independently of the right of withdrawal, all products sold on the colobloom.fr website benefit from the legal guarantee of conformity (Articles L217-3 to L217-20 of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 to 1648 of the French Civil Code).

In the event of a lack of conformity or a hidden defect in the product, these guarantees entitle the Customer to repair or replacement or, failing that, a full or partial refund, at no cost to the Customer.

The Customer has two years from delivery of the product to claim under the legal guarantee of conformity. They may choose between repair and replacement of the product, subject to the cost conditions set out in Article L217-9 of the French Consumer Code.

To invoke either of these guarantees, the Customer can contact the Seller at contact@colobloom.fr, describing the defect.

Article L217-4 of the French Consumer Code (unofficial translation): ‘The seller shall deliver goods in conformity with the contract and shall be liable for any lack of conformity existing at the time of delivery. The seller shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation where the latter was made the seller's responsibility under the contract or was carried out under the seller's responsibility.’

Article 1641 of the French Civil Code (unofficial translation): ‘The seller is bound to warrant against hidden defects in the thing sold which render it unfit for the use for which it was intended, or which so diminish that use that the buyer would not have acquired it, or would only have paid a lower price for it, had they known of them.’

Article 9 – Liability

ColoBloom cannot be held liable for non-performance of the contract in the event of force majeure, disruption or total or partial strikes, particularly of postal services and means of transport or communication.

Article 10 – Disputes and mediation

In the event of a dispute, an amicable solution will be sought first by contacting ColoBloom at contact@colobloom.fr.

In accordance with Articles L.611-1 and R.612-1 et seq. of the French Consumer Code on the amicable settlement of disputes, where the consumer Customer has sent a written complaint to the Seller and has not obtained satisfaction or a reply within two months, they may refer their complaint to the consumer mediator free of charge. The matter must be referred to the mediator within one year of the initial written complaint.

The consumer mediator for the Seller is MCP MEDIATION (Médiation de la Consommation et Patrimoine), which can be contacted:

  • online: www.mcpmediation.org;
  • by post: MÉDIATION DE LA CONSOMMATION ET PATRIMOINE, 12 Square Desnouettes, 75015 Paris, France.

The Customer may also use the European online dispute resolution platform for consumer disputes: consumer-redress.ec.europa.eu

Failing an amicable resolution, the competent courts shall be those of the jurisdiction of the Seller's registered office.

Article 11 – Model withdrawal form

This form only needs to be completed and returned if the Customer wishes to withdraw from their order, in accordance with Article 6 of these T&Cs.
